2. The Service

ESLEPHANT is a platform designed to connect ESL professionals (job seekers) and employers or recruiters (who post ESL job listings). This includes:

Employee Accounts: Job seekers who create profiles and upload resumes (“Employee”).
Employer Accounts: Individuals or organizations who list jobs or access the resume database (“Employer”).
Hybrid Accounts: Accounts that, for any reason, serve both the Employee and Employer functions.

3. User Eligibility and Age Restriction

Age Requirement: By using our Service, you represent and warrant that you are at least 18 years of age. Our Website is not intended for children under 18. If we become aware that a user under 18 has created an account or submitted personal information without proper authorization, we will take steps to remove such information and terminate the account.

4. Account Registration and Information We Collect

When you register an account with ESLEPHANT using the traditional signup method, you will be required to provide your email address. If you sign up via Google, we will collect your email address, first name, and last name from Google.

4.1 Additional Information for Employees (Job Seekers)

If you wish to upload a profile or create a digital resume on ESLEPHANT, you may be asked to provide:

Native language
Gender
Current location
Nationality
First name and last name
Optional profile picture
Education details
Certificates
Work experience
An uploaded resume, which can be made downloadable by potential employers

You can set visibility levels to control who sees your digital resume or downloads it. Note that if an employer has already downloaded your resume, ESLEPHANT cannot control whether they retain or use it after you delete or modify your account.

4.2 Additional Information for Employers

When creating a job listing for the first time, you may be required to provide:

Company name and logo (if your company does not already exist in our database)
Company location and job location
Billing information (e.g., VAT Number, Tax Number, billing address), required if you purchase any of our products (e.g., featured job listings, listing enhancements)

By uploading your company’s logo, you grant ESLEPHANT permission to display that logo on our Website and related marketing materials.

4.3 B2B Sales and Tax Requirements

All sales of our advertising services (such as job listing enhancements) are considered B2B transactions. Depending on the country of origin of the buyer:

The Reverse Charge Mechanism “RCM” may apply if you are located in a jurisdiction where such rules are applicable.
If RCM does not apply, and our business remains below the relevant country’s VAT threshold, we may not be required to register for or charge VAT.
Certain countries are restricted from purchasing our services, including but not limited to: Kenya, Pakistan, Uruguay, Mexico, Russia, Congo, and Kyrgyzstan. ESLEPHANT reserves the right to decline or refund payments from these jurisdictions.

5. Refund Policy

Users may request a refund within 14 days of a successful purchase. All refund requests:

Must be submitted through your user dashboard within 14 days.
Must include a justification for the request.
Will be reviewed by our team.

If a refund is granted, ESLEPHANT reserves the right to terminate or revoke any services that were purchased in connection with that refund (e.g., a featured job listing or listing enhancement).

6. Your Right to Post Content

Our Service allows you to post or upload content, including but not limited to resumes, job listings, profile information, and other user-generated content (“Content”). By posting Content:

You grant ESLEPHANT a non-exclusive, worldwide, royalty-free license to use, modify, publicly perform, display, reproduce, and distribute such Content through our Website and affiliated services.
You retain all rights to your Content, and you are responsible for protecting those rights.

By posting Content, you represent and warrant that:

You own or have the necessary licenses, rights, consents, and permissions to post the Content.
Posting your Content does not violate the rights including privacy rights, publicity rights, copyrights, contract rights, or any other rights of any third party.

7. Content Restrictions

You are solely responsible for the Content and any activity that occurs under your account. You agree not to post, upload, transmit, distribute, store, create, or otherwise publish any Content that:

Is unlawful, harmful, fraudulent, threatening, or defamatory.
Is discriminatory, hateful, or harassing (e.g., commentary about religion, race, sexual orientation, gender, or national/ethnic origin).
Constitutes spam, machine-generated content, chain letters, unauthorized advertising, or gambling.
Contains viruses, worms, malware, Trojan horses, or any other content that could disrupt or harm our Service or that of a third party.

8. User Conduct and Termination

8.1 Grounds for Suspension or Termination

ESLEPHANT may terminate or suspend your account immediately, without notice or liability, if, in our sole discretion, you:

Post or transmit content that is unlawful or otherwise objectionable.
Engage in fraudulent or illegal activities.
Provide false or misleading information.

8.2 Termination Consequences

Upon termination or suspension, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or use the account deletion feature.

11. Account Deletion and Data Retention

If you choose to delete your account, your account will enter a 14-day grace period during which you may log back in to cancel the deletion. After 14 days of no login activity, your account and associated data will be permanently deleted. Please note that ESLEPHANT cannot control whether an employer or third party has downloaded or otherwise retained your resume or personal information prior to deletion.

12. Limitation of Liability

To the fullest extent permitted by applicable law, ESLEPHANT and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses. In any event, ESLEPHANT’s total liability to you for all damages, losses, or causes of action shall not exceed:

The amount actually paid by you to ESLEPHANT through the Service.

Because some jurisdictions do not allow the limitation of liability for certain damages, the above limitations may not apply to you in their entirety. In such jurisdictions, ESLEPHANT’s liability shall be limited to the greatest extent permitted by law.
