- Service refers to the Eslephant website, accessible at https://www.eslephant.com (example URL).

- Job Seeker means a user who signs up to create a profile, upload a resume, and/or search for job listings.
- Employer means a user who signs up to post job listings, search candidate resumes, and/or pay for job posting services or access to the resume database.
- Business under the CCPA refers to the Company, which collects consumers’ personal information and determines the purposes and means of processing that information.
- Consumer under the CCPA refers to a natural person who is a California resident.
- Sale under the CCPA means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating a Consumer’s personal information to another business or a third party for monetary or other valuable consideration.
2. Age Restriction
Our Service is intended for individuals who are 18 years of age or older. If We become aware that a user under 18 has created an account or submitted Personal Data, We will take steps to remove such information and terminate the account. If you believe We might have any information from or about a minor under 18, please contact Us.

3.1 Personal Data
Depending on whether You are a Job Seeker or an Employer, We may collect different types of information:
- Job Seekers: Resume PDF files (which may include first name, last name, nationality, gender, education, certificates, work experience, current location), profile pictures, current location, email addresses, phone numbers, other communication channel handles, and any languages spoken.
- Employers: Business logos, business name, billing information (e.g., tax or registration numbers, VAT number where applicable), postal addresses, job addresses, email addresses.
- Payment Data: Processed by Stripe. We do not store payment card details on Our servers. We may collect or receive billing-related data (e.g., billing address, company info) for invoice/receipt generation and record-keeping.
3.2 Usage Data
We collect Usage Data automatically when You use the Service. This may include information such as your IP address, browser type, browser version, the pages You visit, the time spent on those pages, device identifiers, and other diagnostic data.
3.3 Cookies and Tracking
We use Cookies to manage sessions and authenticate users. By signing in or registering, You acknowledge that certain Cookies are essential for the Service to function. You can configure Your browser to refuse all Cookies or to indicate when a Cookie is being sent, but if You refuse essential Cookies, some portions of the Service may not be accessible or functional.
4. Use of Your Personal Data
4.1 Job Seekers
- Creating a Profile: We use the information You provide (resume details, education, etc.) to create a digital profile viewable by Employers in Our resume database or to facilitate job applications.
- Visibility Options:
- If Your profile is set to “visible,” Employers who have access to the resume database or job postings You apply to will see Your information.
- You may choose to hide your profile, limiting the exposure of Your data to Employers.
- If an Employer has already downloaded or copied Your resume, We cannot control how they retain or use this information after You modify or delete your account.
4.2 Employers
- Billing and Accounting: We collect billing information to generate invoices, receipts, and for accounting and record-keeping purposes.
- Job Postings: We use Employer data (e.g., business name, address, logo) to display job listings and enhance credibility of the listings.
4.3 General Uses
- Communications: We may contact You by email or other means regarding updates, offers, or important notices.
- Analytics: We use aggregated data for internal analysis to improve the Service.
- Security: We may use Personal Data to monitor for suspicious activity, fraud, or security issues.
- Age Verification: We reserve the right to verify the age of users to ensure compliance with our restrictions (18+).
5. Data Retention
- Account Duration: We retain user data for as long as the user maintains an active account on Our Service.
- Account Deletion and 14-Day Grace Period: When You delete Your account, Your personal data is scheduled for deletion after a 2-week (14-day) grace period. If You do not log in during that time, Your account and associated data will be permanently removed. We cannot control data already downloaded by third parties before deletion.
- Billing Information: We may retain billing and invoicing records to comply with legal or accounting obligations (often 5–7 years or as required by law).
6. User Rights and Controls
- Access, Correction, and Deletion: You can review, edit, or remove Your personal data through Your account dashboard. Once You delete Your account (and after the 14-day grace period), personal data associated with it will be removed from Our active systems, except where retention is required for legal or accounting purposes.
- Profile Visibility: Job Seekers can toggle their profile visibility. If hidden, Employers will not be able to view Your resume or profile unless required by law or special circumstance.
- Opt-Out of Data Collection: You may refuse essential Cookies, but this will limit certain functionalities. For non-essential communications, you can unsubscribe or opt out. Otherwise, deleting Your account remains the primary means to discontinue data collection.
7. Security of Your Personal Data
We host Our database on a managed service (e.g., DigitalOcean or similar) and implement reasonable security measures such as access controls and encryption in transit (HTTPS). Only authorized staff (administrators) have direct access to the database. While We strive to use industry best practices, no transmission or storage system is 100% secure.
8. International Users and Legal Jurisdictions
Our Service is available worldwide, and We make good-faith efforts to comply with relevant data protection regulations such as GDPR (for EU users) and CCPA (for California users). By using the Service, You acknowledge that Your data may be transferred to and processed in countries that may have different data protection laws than Your home country.
9. Sharing Your Personal Data with Third Parties
- Stripe (Payment Processing): When You make a payment, We share necessary information (e.g., Your email for receipts) with Stripe. Stripe’s own privacy practices govern any payment details You provide.
- Employers (Job Seeker Data): If You are a Job Seeker with a visible profile or You apply to a job, We share Your data with the relevant Employer(s). Once shared, the Employer may retain Your data independently.
- Analytics (e.g., Google Analytics): We use analytics tools to understand how users interact with Our website. These tools may collect data such as IP addresses and browsing behavior. You can opt out by installing the Google Analytics opt-out browser add-on (where applicable).
- Service Providers: We may share data with trusted partners who help operate or improve Our Service. These partners are obligated not to use or disclose it for purposes beyond providing services to Us.
- Law Enforcement and Legal Obligations: We may disclose Your personal data if required to do so by law or in response to valid requests from public authorities.
10. Restricted Purchases and Countries
Our Service may restrict purchases from specific countries (e.g., Kenya, Pakistan, Uruguay, Mexico, Russia, Congo, Kyrgyzstan) due to tax, legal, or regulatory considerations. This restriction may affect whether We process certain billing or personal data from those locations.
